Ghosts at mardin?

I just played the Mardin episode and am trying to figure out if I found a bug or an encounter. Every once and awhile while going through the graveyard either someone would take a shot at my squad or my squadies would shoot at someone, but before I could find the encounter, the target would disappear. I am playing squad turn based and I would expect that the game would shift to turn based after the first shot, and it does, but I don't usually see the bad guy, but a couple of times I thought I saw him duck behind a wall or a grave and then vanish.

Is this a beastlord sniper operating in stealth mode? Or is at glitch and I am shooting down at the characters below through some strange window in the programming?

Has anyone else seen this? If its a stealth badguy, this is pretty cool, but trying to trap him is a pain in the ass.
 
Normally when something like this happens, it happens because the guy gets out of your line of sight. Ducking behind a grave means you can't see him anymore therefor he 'vanishes'. This was one thing i immediatly pointed out to the developers after playing the demo. It was sooooooooooooo annoying to have a guy duck behind his cover and then he would use up all his left over ap to move. I throw a grenade over the cover, nothing, he pops up, pops back down, moves, i throw grenade, nothing. Yep it's sometimes pretty frustrating.

Actually there are some holes through floors and walls in various levels throughout the entire game. It is a tile glitch that sometimes appears and you can even take advantage of it by killing some more difficult enemies by "shooting through the walls". The person that is shooting at you in Mardin is underground beneath the cemetary.

patch ur game to 1.27 ( 1.25 works too )
